The Purposes and Legal Basis for our Processing of Personal Data

Marketing

If you choose to subscribe to our mailing list, U.Emme uses your name and e-mail address for the purpose of direct marketing by sending you newsletters about for example our products, events and further information regarding the U.Emme world. The legal basis for this processing is that you have given consent to the processing of your e-mail address for the purpose of direct marketing and/or that it is necessary in order to meet U.Emme’s legitimate interest of direct marketing our products and services.

Contact

If you contact us through our contact form or by e-mailing us we will use the data you send to us, including for example your name and e-mail address, for the purpose of communicating with you and otherwise handle your inquiries and requests. The legal basis for this processing is that it is necessary to meet your and U.Emme’s legitimate interest of contact and otherwise handling your request.

Career

If you send us your résumé or job application we will use the personal data you send to us to evaluate your skills profile matching of the job requirements and to contact you once the process is complete. The legal basis for this processing is that it is necessary in order to take steps at your request prior to entering an employment agreement and that the processing is necessary in order to meet your and U.Emme’s legitimate interest handling your job application.

Legal obligations

U.Emme may also process your personal data to comply with legal obligations, for example related to product safety, use and maintenance. The legal ground for this processing is that it is necessary for compliance with legal obligations to which U.Emme is subject.

Recipients of your Personal Data

We do not sell or trade your personal data with third parties.

U.Emme shares personal data with processors, such as firms assisting U.Emme in operating our site, logistics and shipping companies, payment service companies and marketing firms, who process your personal data on U.Emme’s behalf. When doing so U.Emme always makes sure to have relevant data protection agreements in place to safeguard your personal data and make sure that it is only processed for our intended purpose.

When legally obliged to do so, U.Emme may also share your personal information with public authorities who are independent controllers and thus process your data for the purposes and means determined by them.

Is Your Data Transferred to Third Countries?

Our web server processes a series of data for each request, which your browser automatically transmits to our web server. This data comprises the IP address currently assigned to your device, the date and time of the request, the time zone, the specific page or file called up, the http status code and the amount of data transferred. Additionally, the website from which your request came, the browser used, the operating system of your end device and the set language. The web server uses this data to display the contents of this website in the best possible way on your device.

The U.Emme website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. IP anonymization is activated for this website, meaning Google will shorten your IP address within the European Union or in another contracting state to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

Google will use this information as a processor according to Art. 28 GDPR to evaluate your use of the website, to compile reports on the website activities and to provide the website’s operator with further services connected with the use of the website and the internet. The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.

You may refuse the use of cookies by selecting the appropriate settings on your browser. You can prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the available browser plug-in

The purpose of data processing is to present U.Emme Srl on the internet and to communicate with interested parties, customers and business partners. The purpose of evaluating user behavior on the website is to design the website in line with their requirements.

The legal basis for processing is Art. 6 (1)(a) GDPR (Consent to the processing of personal data for one or more specific purposes). The legal basis for the analysis of user behavior is Art. 6 (1) (f) GDPR (legitimate interest, namely the demand-oriented design of the website).

Protocol and communication data will not be transferred to third parties unless special circumstances have arisen. If a criminal offence is suspected or in the course of an investigation, data may be transferred to the police and the public prosecutor's office. We use service providers to process orders for the provision of our services, in particular for the provision, maintenance and servicing of IT systems. 

If you choose to subscribe to our mailing list, U.Emme transfers your e-mail address to The Rocket Science Group (MailChimp), which is part of the U.S. Privacy Shield Framework.

The EU Commission has decided that companies who are part of this framework ensures an adequate level of protection.

The use of the website is not possible without disclosure of personal data, such as the IP address. Communication via the website without providing data is not possible.

For How Long Does U.Emme Store Your Personal Data?

Personal Data which has been collected for the performance of a purchase agreement is as a main rule stored during one year after the end of the product’s warranty time, provided that there are no outstanding issues related to the product and that U.Emme does not have a legal obligation to save the data longer. U.Emme will however store information related to the functionality of our products, including their serial numbers, during ten years after the transaction date in order to give you and potential future owners a high quality of service in relation to the specific product.

Information which has been registered in the Contact Form will be stored for as long as U.Emme considers it necessary.

We will store your name and e-mail address for the purpose of direct marketing until you object to this or withdrawal your consent. If you do so, we will immediately erase the data from the list.

Your Rights

You have a number of rights concerning the processing of your personal data and you are always welcome to contact us concerning this on privacy[at]uemme[dot]com. According to GDPR you for example have a right to, under certain conditions:

- be informed of how your data is being used by U.Emme and its processors; 
- access personal data that U.Emme has about you; 
- ask U.Emme to correct inaccurate personal data; 
- require U.Emme to delete your personal data; 
- request transfer of your data to another controller; 
- object to certain kinds of processing; 
- ask us to restrict the processing of your personal data.

You Have the Right to Withdraw Your Consent

Where U.Emme processes personal data based on your consent, you always also have the right to withdraw the consent. This will however not affect the lawfulness of processing based on you consent that has taken place before the consent was withdrawn. 

Direct Marketing

You always have the right to object to our processing of your personal data for the purpose of direct marketing and profiling to the extent that it is related to such direct marketing. U.Emme will then make sure to cease the use of your data for direct marketing. 

Children's Online Privacy Protection Act ("COPPA")

U.Emme Srl does not knowingly collect or use personal information from children under 13 years without containing verifiable consent from their parents. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce this privacy policy by instructing their children never to provide personal information without their permission.
